Parties

This section outlines the general and legal responsibilities of Grain Bulker ("Grain Bulker" or "We" or "Us") and the use of the Grain Bulker website (currently located at www.grainbulker.com) by you ("the User" or "You") (paid or free).

Grain Bulker subscriptions are valid for one year (365 days).

Before using the Grain Bulker website, please carefully read the following Terms and Conditions and the Grain Bulker Privacy Policy (together referred to as the "Agreement") that govern your use of the Grain Bulker website. If you do not accept these Terms and Conditions, please refrain from using the Grain Bulker website for any reason.

This Agreement is entered into between you ("the User" or "You"), as the user of the Grain Bulker website, and the owner of the Grain Bulker website.

Grain Bulker Services

This Agreement encompasses the following services offered by Grain Bulker Services.

"Grain Bulker" is a product and database name of Grain Bulker Information Systems Industry and Trade Ltd. Co. The Grain Bulker website and its services, Grain Bulker databases, data, and products are collectively referred to as "Grain Bulker Services" in these "Terms and Conditions" and the Grain Bulker Privacy Policy. This document explains how the agreement is formed and sets out the terms of that agreement.

Unless otherwise specified in a written agreement with Grain Bulker, your agreement with Grain Bulker will always include, at a minimum, the terms and conditions set out in this document.

You understand and agree that Grain Bulker will consider your use of the Grain Bulker Services as an acceptance of the terms and conditions outlined in this document from that point onwards.

"Grain Bulker Services" is a trade/business information service centrally managed by Grain Bulker and includes the provision of trade/business data and information compiled, processed, and organized using a method developed by Grain Bulker, along with other related services.

Most of the Grain Bulker Services can only be accessed through registration and are not available to all users. By registering for the restricted areas of the Grain Bulker Services, you agree to the sections of this Agreement that apply to those Grain Bulker Services.

You acknowledge and agree that Grain Bulker may permanently or temporarily cease to provide the "Grain Bulker Services" (or any of its features) to you or to Users in general, at Grain Bulker's sole discretion, without prior notice to you. You may stop using the "Grain Bulker Services" at any time, and you do not need to specifically inform Grain Bulker when you decide to do so.

You acknowledge and agree that if Grain Bulker disables access to your username and password, you may be prevented from accessing the "Grain Bulker Services" or other content provided by Grain Bulker.

Grain Bulker reserves the right to amend, modify, or suspend the form and nature of the "Grain Bulker Services" (or any part thereof) from time to time. You acknowledge and agree that Grain Bulker can restrict the usage of the "Grain Bulker Services" at any time, at Grain Bulker's discretion.

The "Grain Bulker Services" cannot be used as part of any product or service or provided to any third party by any individual or organization that competes with the business or products of Grain Bulker.

User Liabilities

The risks associated with using the Grain Bulker Services on the Grain Bulker website belong to the users.

You agree to use the "Grain Bulker Services" only for purposes permitted by the Terms and Conditions outlined in this agreement and any applicable laws, regulations, or generally accepted practices or guidelines in the relevant jurisdictions.

You agree not to reproduce, duplicate, copy, sell, trade, market, distribute, publish, transfer, resell, or engage in any automated browsing or downloading of the "Grain Bulker Services," products, and database information for any purpose other than for the internal purposes of your business.

Grain Bulker grants the User (for as long as the User has a valid subscription with us) a personal and non-transferable username and password to access and use the Grain Bulker Services for internal purposes only, in accordance with the Terms and Conditions of this Agreement. The User shall not assign, dispose of, sublicense, or otherwise transfer the rights granted by this Agreement. In particular, the User shall not allow any other person to use or have access to the Grain Bulker Services.

The User agrees to promptly respond to all questions received through all communications sent by the Grain Bulker Services. In order to access certain "Grain Bulker Services," you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the "Grain Bulker Services" or as part of your continued use of the "Grain Bulker Services." You agree that any registration information you provide to Grain Bulker will always be accurate, correct, and up to date.

You agree not to engage in any activity that interferes with or disrupts the Grain Bulker Services and the servers and networks connected to the Grain Bulker Services.

Using the Grain Bulker Services for "spamming" and/or unlawful unsolicited marketing is expressly prohibited.

You agree that you are solely responsible for (and that Grain Bulker has no responsibility to you or to any third party for) any breach of your obligations under the Terms and Conditions and for the consequences (including any loss or damage suffered by Grain Bulker) of any such breach.

You understand and agree that your use of the "Grain Bulker Services" is at your sole risk and that the services are provided "as is" and "as available."

Grain Bulker does not warrant that the software on its site is free from all faults and does not guarantee the absence of any viruses on the site. If the software and hardware you use are damaged by any software used on the Grain Bulker website, we are not responsible for such damage.

All risks related to the links on the Grain Bulker website are the responsibility of the User.

Grain Bulker websites have the right to use all your membership information for their commercial activities.

The User may not use the Grain Bulker Services for illegal purposes.

Fees and Security

If the User wishes to access certain parts of the Grain Bulker Services that are not freely available to all users, the User will be required to pay non-refundable fees to Grain Bulker for access/subscription units based on the rates specified by Grain Bulker from time to time.

There are no refunds or cancellations for Annual Grain Bulker Member Service Sales made by credit cards.

The User may be offered the opportunity to pay for access to the Grain Bulker Services by providing credit card details over the Internet. Like any other communication systems, there are risks of interception associated with sending information over the Internet. Although Grain Bulker has taken all normal precautions to minimize the risk of interception, the User acknowledges that any information is transmitted at the User's own risk and that Grain Bulker shall have no liability for the security of this information while it is being transmitted.

In accessing any of the Grain Bulker Services, the User shall comply with any additional terms and conditions for that service issued from time to time by Grain Bulker.

The User will protect any Grain Bulker Services available to them from unauthorized access by third parties and will follow all
